Can I divorce in Singapore?


In the event when a marriage has broken down to such a point that parties are considering to file for divorce. One of the first looming question that will no doubt flash across their minds is: Can I get a divorce?

This is an extremely crucial question as divorce is not as of right under Singapore’s divorce laws. One can’t simply go to court or unilaterally declare that they are divorced. Marriage is a sacred institution protect by the government. Like a Marriage, divorce is a life changing decision that will not only affect the two parties but the lives of their children and extended family in particular. People simply can’t get married for the fun of it.

To be eligible to apply for a divorce at the Family Justice Courts in Singapore ( ie the first step in obtaining a divorce):
  1. You and your spouse cannot be Muslim or Married under the Muslim Law
  2. Your marriage must have lasted at least 3 years, or if you have the Court’s permission to do so
  3. With regards to nationality 
    1. You and your spouse are Singaporean Citizens
    2. You and your spouse have lived in Singapore for at least three years before you apply for a divorce
    3. You and your spouse are domiciled in Singapore

In unfortunate situations where you can’t find your spouse, you may still proceed with your divorce application at the Family Justice Courts. However, the divorce procedure in Singapore still require you to serve document on your spouse.

Ultimately, filing a divorce is a complex matter especially for those who are already in a troubled and stressful situation. Furthermore, issues of eligibility becomes a lingering concern if either you or your spouse are not Singaporean citizens. Nevertheless, there is no hard and fuss rule that you must engage a lawyer. However, should you choose to represent yourself, you are not exempted from the legal, procedural and formal requirements in Court proceedings. Furthermore, it is not the role of the Family Justice Courts cannot advise you on what to do, only a lawyer would be able to.
